DUTIES
Our Directorate operates to represent the legal entity of the Pendik Municipality before judicial authorities and to protect its rights and interests. It also provides legal consultancy services to the senior management and other municipal directorates as needed.
Monitor the legislation related to the Directorate’s activities and fulfill its requirements within the specified time.
Carry out and finalize tasks and procedures that need to be followed with other authorities.
Conduct activities in accordance with the strategic plan, annual performance program, investment program, and the Directorate’s budget.
Undertake necessary work to fulfill the duties and responsibilities outlined in the Pendik Municipality Internal Control Action Plan.
Respond to incoming letters and petitions within the specified time. According to Law No. 3071, provide written information within 30 days for applications made via petition, and additionally notify the results if the process progress is announced.
Present information and documents to applicants under the Law on the Right to Information No. 4982, with the knowledge and approval of the Mayor or relevant Deputy Mayor, except for exceptions.
Conduct necessary work to determine the Municipality’s medium- and long-term strategies and policies and set objectives.
Ensure records of the Directorate’s transactions are maintained, archived, preserved, and safeguarded when necessary.
Correspond with other municipal units, official institutions, professional chambers, and parties involved in the tender process when necessary.
Provide the Press, Publication, and Public Relations Directorate with necessary data for announcements and promotion related to the Directorate’s responsibilities.
File lawsuits on behalf of Pendik Municipality, defend the Municipality in cases filed against it, manage and finalize lawsuits.
Conduct enforcement proceedings on behalf of the Municipality and manage enforcement proceedings filed against the Municipality.
Provide legal opinions on doubtful matters when requested by relevant municipal units.
Represent the Municipality legally before relevant authorities to protect its rights and interests, conduct correspondence under the powers of attorney, and file criminal complaints when necessary.
Receive notifications related to legal procedures.
Handle internal and inter-institutional correspondence and requests regarding lawyers’ assigned files, legal opinions, and other documents.
Decide whether to file objections or appeals against final court decisions.
Correspond with all public law entities (judicial and administrative authorities) and private law entities regarding matters within the Directorate’s area of responsibility.
Perform other duties assigned by legislation.
Provide opinions and legal assessments regarding the procedures and principles that must be followed in municipal directorates’ activities to resolve legal disputes.
Initiate legal proceedings to resolve disputes for municipal directorates’ activities with the approval of the Mayor.
Track lawsuits or enforcement proceedings initiated by or against the Municipality.
Provide guidance to staff and citizens on legal procedures through lawyers at the Directorate, either in person or by phone.
File criminal complaints with the Public Prosecutor’s Office regarding unlawful acts identified during municipal procedures.
Provide written information to citizens requesting information about lawsuits filed by or against the Municipality.
Handle mediation applications for labor claims and commercial disputes filed against the Municipality and resolve them favorably without filing a lawsuit if possible.
Monitor all processes, including hearings and enforcement proceedings, related to labor disputes filed against the Municipality.
File recourse lawsuits against contractor companies for payments made as a result of labor disputes and monitor these cases.
Organize mediation commissions, participate in mediation sessions, and implement agreed decisions for labor and commercial disputes.
File counter-lawsuits in judicial or administrative courts against expropriation without compensation or price increase claims filed against the Municipality and handle related procedures.
Conduct settlement negotiations with property owners regarding expropriation without compensation claims and collaborate with relevant institutions in accordance with Law No. 6745.
Coordinate and monitor lawsuits related to municipal properties, including expropriation, expropriation without compensation, price increase, partition, and title deed cancellation cases, and conduct necessary correspondence with relevant institutions.
Participate in reconciliation discussions and take necessary actions to protect the Municipality’s rights and interests.
Calculate current property values in expropriation, expropriation without compensation, or price increase cases, apply a 15% discount for settlements, which can also be achieved through parcel transfers.
